Therefore CircusTalk.com (herein referred to as the "Website", which is owned and operated by CircusTalk, LLC. registered office276 Fifth Avenue, New York, NY 10001; e-mail: [email protected] ("Circus Talk")) has created this Privacy Policy to explain how your information is protected, collected and used. This Privacy Policy applies to our Website. This Privacy Policy may be updated from time to time. You can always review the most current version in the Legal menu. If we make a change to this policy that, in our sole discretion, is material, we will notify you via a CircusTalk update or direct email to the email address associated with your account. By continuing to access or use the Services after those changes become effective, you agree to be bound by the revised Privacy Policy.

By using the Website, you consent to the terms and conditions of this Privacy Policy and are aware that our policies may evolve in the future. If there is a conflict between our Terms of Service governing your use of the Website and this Privacy Policy, the Terms of Service control.

In various places on the Website, we collect personal information, information that can be used to identify you or contact you based on your consent. Your consent can be withdrawn at any time, without affecting the lawfulness of processing based on consent before its withdrawal. Personal information will be processed until the withdrawal of consent. You can always refuse to supply this information with the caveat that it may prevent you from engaging in certain Website-related activities.

CircusTalk will not share any of your personal information, except for the information you choose to publicly disclose in the material you publish, with our advertisers or any third-parties for marketing purposes. Account information is password protected. Keep your password safe.

CircusTalk, or people that place postings on the Website, may provide links to third party web sites, which may have different privacy practices than CircusTalk. We are not responsible for, nor have any control over, the privacy policies on these third party websites. We encourage all users to read the privacy policies of every website you visit.

Under no circumstances will CircusTalk be liable for user generated content including but not limited to personal data in any Content posted, emailed, transmitted or otherwise made available via the Services or broadcast elsewhere.

Information We Collect

By signing up to CircusTalk.com you have a choice of using Facebook or e-mail login. By choosing Facebook Connect, you are authorizing CircusTalk to collect, store, and use, in accordance with this Privacy Policy, any and all information that you agreed that Facebook, Inc. ("Facebook") could provide to CircusTalk through Facebook's Application Programming Interface ("API"). Such information may include, without limitation, your first and last name, Facebook username, Facebook profile picture, unique Facebook identifier and access token, and e-mail address.

Facebook Connect give you the option to post information about your activities on the Platform to your profile page to share with others within your network or opt out of information you do not wish to share. Facebook Connect enables CircusTalk to provide cross-posting options, thus helps us improve our Services.

Instead of logging in through Facebook Connect, you may register at CircusTalk by creating login credentials using your name and e-mail address.

At registration on CircusTalk, depending on your member type, you must provide us with some information, such as your first name, last name, gender, company’s name, password, email address, your primary role in the circus industry, your birthday (if relevant), language(s) spoken (if relevant) and your country of nationality or origin, current location and contact information (contact e-mail, address, phone, skype, website) that will appear on your Member Profile Page. You can control in Edit Profile which of this information you want to share publicly. Your registration e-mail, your date of birth and your gender are not displayed publicly on CircusTalk.  You can choose to add an e-mail address, or profile picture that is publicly available on your profile. Information provided at registration allows the community to find you and make contact with you. Some Services, such as basic search do not require registration.

As an Individual Member, you can choose to provide further information about yourself during the registration process such as your work, education and awards. Institutional members are required to provide information such year of establishment and size of the organization. CircusTalk uses this information to provide you with more customized services such as specific content, updates, relevant career opportunities. You understand that, by creating an account, CircusTalk and others will be able to identify you or your organization by your CircusTalk profile, and you allow CircusTalk to use this information in accordance with this Privacy Policy and our Terms of Service. With your approval, your connections may provide recommendations and endorsements of you.

We may also ask for your credit card details if you purchase certain CircusTalk services.

Performer and Company registered users may open an act or a touring show page. Depending on the page type you can provide short description of your business, credits, photos, videos, technical information and contact information. You accept the fact that registered users can review your personal or business profile and your pages. CircusTalk has no control over these reviews.

Providing further information about yourself and/or about your business enables you to receive the maximum benefit from CircusTalk by articulating your professional identity, finding information and other professionals opportunities and potential business partners. Your member profile, act and touring show profile is an essential tool for recruiters or potential business partners to find you and learn more about you. A fully developed profile page also enables CircusTalk to serve you ads and other relevant content information.

In addition to personal or business related information you provide at registration or by using the Service, we collect the following additional information:

  1. Postings content. When you place a posting or a review on the Website, we collect a variety of information related to that posting (e.g., the description of a service, product or event). The public will see any information that you include in your posting, and as such, Circus Talk has no control over how this information will be used. For that reason, please think carefully about what Personally Identifiable Information you disclose in your posting. You can always edit or deactivate any of your postings.
  2. Discussions about postings. When you comment on a posting. However, you can always delete your comments
  3. Correspondence. Correspondence between you and the other party initiated through our Website, and correspondence to us
  4. "Anonymous Information" such as your IP address, the type of browser you use, the pages on our Website that you visit, the search terms that you enter and the advertisements that you click. This information is used to help us diagnose problems, administer the Website and otherwise improve our Service to you.
  5. Credit card information. Credit card information, including credit card numbers, is collected but not stored. We use trusted third party vendors to handle secure credit card transactions for us. Our vendors use Secure Socket Layer (SSL) technology and are PCI compliant.

Although we make good faith efforts to store information in a secure environment that is not made available to the public, we cannot guarantee complete security.

We may use the information you disclosed to us to provide our services and/or customer service to you, to prevent potentially prohibited or illegal activities, to enforce our Terms of Service and to scan messages automatically to check for spam, fraud, phishing attacks and other malicious activity or illegal or prohibited content.

Our Services are primarily designed to help you easily share information with the circus community. Most of the information you provide us is information you are asking us to make public. This includes not only your posts and the metadata provided with your posts, but also the people you follow, the posts you like, mark as favorite or share and many other bits of information that result from your use of the Services. Our default is almost always to make the information you provide public for as long as you do not delete it from CircusTalk, but we generally give you settings to make the information more private if you want. Your public information is broadly and instantly disseminated. For instance, your Profile Page and public posts may be searchable by search engines and are immediately delivered via SMS and our APIs to a wide range of users and services. When you share information or content like photos, videos, and links via the Services, you should think carefully about what you are making public.

CircusTalk may keep track of how you interact with links across our Services, including our email notifications, third-party services, and client applications, by redirecting clicks or through other means. We do this to help improve our Services, to provide more relevant advertising, and to be able to share aggregate click statistics such as how many times a particular link was clicked on.

Registered users, who provide their email address to CircusTalk may receive a copy of our newsletter, notifications and other occasional mailings from us regarding our Service or the Website. You may use your account settings to unsubscribe from these notifications or by following the instructions contained within the notification. By creating a SHOW page, you accept to receive emails that relate to the maintance and functionality of your show page, such as cast list and other acts notifications.

CircusTalk doesn't make any e-mail address provided at registration public unless you chose to make it public. For those who wish to keep their e-mail address hidden from the public, CircusTalk's in-house messaging system provides the tool to get in touch with other members.

Like many websites, we use cookies and similar technologies to collect additional website usage data and to improve our Services. A cookie is a small data file that is transferred to your computer's hard disk. Twitter may use both session cookies and persistent cookies to better understand how you interact with our Services, to monitor aggregate usage by our users and web traffic routing on our Services, and to customize and improve our Services. Most Internet browsers automatically accept cookies. You can instruct your browser, by changing its settings, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. CircusTalk uses a variety of third-party services to help provide our Services, such as hosting, and to help us understand the use of our Services, such as Google Analytics. These third-party service providers may collect information sent by your browser as part of a web page request, such as cookies or your IP address. Third-party ad partners may share information with us, like a browser cookie ID or cryptographic hash of a common account identifier (such as an email address), to help us measure ad quality and tailor ads. For example, this allows us to display ads about things you may have already shown interest in. By registering at CircusTalk you automatically accept this.

Others

You can modify both your Profile Page and Act or Touring Show Page profile anytime. If you are a registered user of our Services, we provide you with tools in Account Settings to access or modify the personal information you provided to us and associated with your account.

You can also permanently delete your CircusTalk account. Following the instructions stated in the help menu, your account would be deactivated and then deleted. When your account is deactivated, it is not viewable on CircusTalk.com. For up to 30 days after deactivation it is still possible to restore your account if it was accidentally or wrongfully deactivated. After 30 days, we begin the process of deleting your account from our systems, which can take up to a week.

CircusTalk use has an age restriction. We do not provide service to persons under 13. If you become aware that your child has provided us with personal information without your consent, please contact us [email protected]. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we take steps to remove such information and terminate the child's account.

CircusTalk may disclose information about its users if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to a legal process (e.g., subpoenas, court orders), respond to claims that a posting or content violates the rights of third parties, enforce our Terms of Service or to protect the rights, property or personal safety of CircusTalk, its users or the general public.

CircusTalk may also disclose information with its partner websites if you create an account on one of those sites and service providers under contract who help us with business operations such as fraud investigations.

We may share personal and other information about you with our affiliates, and subsidiaries for the use and benefit of those companies. If we merge with or are acquired by another company, the resulting combined company will use the information you have provided as described in this Privacy Policy.

You may request from Circus Talk

  1. access to your personal data,
  2. rectification of your personal data, and
  3. erasure or restriction of your personal data

The right of access:

You may access all your personal data on your profile via EDIT PROFILE profile settings. You shall have the right to obtain from Circus Talk confirmation as to whether or not your personal data is being processed, and where that is the case, access to your personal data. We shall provide a copy of the personal data undergoing processing. For any further copies requested by you, we may charge a reasonable fee based on administrative costs. You may request access by contacting [email protected].

If your request is made by electronic means, the information shall be provided in a commonly used electronic form.

Right to rectification:

You may rectify your personal data via EDIT PROFILE settings (https://circustalk.com/members/edit/profile)

You shall have the right to obtain from Circus Talk without undue delay the rectification of inaccurate personal data concerning you.

Right to erasure:

You may delete your personal data by editing your profile via EDIT PROFILE settings (https://circustalk.com/members/edit/profile) or by following the delete profile instruction in the HELP menu. https://circustalk.com/faq#subcategory_42

You shall have the right to obtain from Circus Talk the erasure of your personal data without undue delay and We shall have the obligation to erase your personal data without undue delay where one of the following grounds applies:

  1. the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;
  2. you withdraw your consent on which the processing is based and there is no other legal ground for the processing;
  3. you object to the processing and there are no overriding legitimate grounds for the processing, or you object to the processing;
  4. your personal data have been unlawfully processed;
  5. your personal data have to be erased for compliance with a legal obligation;
  6. your personal data have been collected in relation to the offer of information society services.

Right to restriction of processing:

Where processing has been restricted, such personal data shall, with the exception of storage, only be processed with your consent or for the establishment, exercise or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or of a Member State.

Right to data portability:

You shall have the right to receive your personal data, which you have provided to Circus Talk, in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller without hindrance from Circus Talk to which the personal data have been provided, where:

  1. the processing is based on consent or on a contract; and
  2. the processing is carried out by automated means.

General rules regarding the data subjects’ rights:

We shall provide information on action taken on your request without undue delay and in any event within one month of receipt of your request. That period may be extended by two further months where necessary, taking into account the complexity and number of the requests. We shall inform you of any such extension within one month of receipt of the request, together with the reasons for the delay. Where you make the request by electronic form means, the information shall be provided by electronic means where possible, unless you otherwise request.

Information to you and any actions taken shall be provided free of charge. Where your requests are manifestly unfounded or excessive, in particular because of their repetitive character, We may either:

  1. charge a reasonable fee taking into account the administrative costs of providing the information or communication or taking the action requested; or
  2. refuse to act on your request. We shall bear the burden of demonstrating the manifestly unfounded or excessive character of your request.

Where We have reasonable doubts concerning the identity of the natural person making the request, We may request the provision of additional information necessary to confirm the identity of the data subject.

International Users

If you use the Website from outside of the United States, you are voluntarily agreeing that CircusTalk's collection, use, storage and sharing of your information and content is exclusively subject to the laws of the United States, not of the jurisdiction in which you are located. Privacy Complaints from European Union Citizens: In compliance with the Safe Harbor Principles, CircusTalk commits to resolve complaints about your privacy and our collection or use of your personal information. European Union citizens with inquiries or complaints regarding this privacy policy should first contact CircusTalk at [email protected]. CircusTalk has further committed to refer unresolved privacy complaints under the Safe Harbor Principles to an independent dispute resolution mechanism, the BBB EU SAFE HARBOR, operated by the Council of Better Business Bureaus. If you do not receive timely acknowledgment of your complaint, or if CircusTalk does not satisfactorily address your complaint, you may contact the BBB EU SAFE HARBOR program at: http://www.bbb.org/us/safe-harbor-complaints.
